1. Acceptance of Terms

By accessing or using Emoji Racer ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Use of the Service

Emoji Racer is a multiplayer typing race game that allows you to:

• Compete in typing races against other players or AI opponents
• Track your typing speed (WPM) and accuracy
• Earn XP, level up, and unlock emoji avatars
• Climb leaderboards and earn achievements
• Challenge friends to races

3. User Accounts

You may use the App anonymously or create an account. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Choosing an appropriate display name (no offensive content)

4. Acceptable Use

You agree NOT to:

• Use automated tools, bots, or scripts to gain unfair advantages
• Exploit bugs or glitches for competitive advantage
• Use offensive, inappropriate, or misleading display names
• Harass, abuse, or threaten other users
• Attempt to reverse engineer or hack the App
• Share or sell your account

Violation of these terms may result in account suspension or termination.

5. Fair Play

Emoji Racer is designed for fair competition. Copy-pasting during races is technically prevented. We continuously monitor for cheating and may:

• Remove scores that appear fraudulent
• Ban accounts engaging in cheating
• Reset leaderboards if widespread cheating is detected

6. Intellectual Property

All content in Emoji Racer, including but not limited to text, graphics, logos, race content, and software, is owned by psquared GmbH and protected by copyright and intellectual property laws.

7. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of leaderboards or statistics
• Availability at all times

8. Limitation of Liability

psquared GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated through the App. Continued use after changes constitutes acceptance of the new terms.

10. Termination

We may terminate or suspend your account at any time for violations of these terms, without prior notice. You may delete your account at any time through the app settings.

11. Governing Law

These Terms shall be governed by the laws of Austria. Any disputes shall be resolved in the courts of Linz, Austria.
